Important information for passengers

Passengers who are late for check-ending time finishing 40 minutes prior the departure time indicated on the air ticket are not accepted for carriage by this flight.

Carrier has the right to refuse in carriage:

 

• If it is necessary to ensure the health and safety of passengers;
• In an effort to prevent violations of relevant laws, regulations, rules and regulations of public authorities of any country, in/from/through the territory of which such a carriage is carried out;
• If a passenger refuses to comply with the rules, regulations and instructions of the Carrier;
• Due to illness of the passenger if his/her health condition creates a hazard to the patient him(her)self or surrounding people;
• When the passenger has improperly executed documents.

 

And as well as:

 

• Persons posing a threat or might cause harm to other persons or their property;
• A passenger suffering from alcohol or drug intoxication;
• A passenger whose actions violate the established common rules of air travel.

 

However, in some cases, when a passenger is denied in boarding the booked flight through the fault of the Carrier, the latter may provide additional services or pay out compensation in accordance with established standards.

 

Reimbursement in whole or in part for the unused part of the carriage is carried out at the place of purchasing the air ticket within one year from the date of issuance, if the carriage was not performed on any of the sites or from the date of departure on the first part of the journey (unless otherwise provided by the Tariff Application Rules).

 

When buying an air ticket or changing conditions of carriage after the acquisition (name, flight, class of service, date of departure in the forward and reverse destinations, etc.), please consult with the Carrier or his agent on the conditions of the applicable fare, so that you could help in the presence of constraints that may occur. Failure to comply with this recommendation may lead to an increase in fare and/or additional costs for you. In some instances, the charges are applied for refusal from the flight or changed booking in air tickets checked-in at special rates.

TERMS AND CONDITIONS

1. The terms used in this Contract mean the following:

 

• Air ticket is a passenger’s air ticket and baggage check,
• Carriage is equivalent to “transportation”, “air carrier” is all air carriers that carry or undertake to carry a passenger or his baggage hereunder this Contract or perform any other service related with this  air carriage;
• Warsaw Convention is a Convention for unifying certain rules relating to international air carriages signed at Warsaw, Poland, on October 12, 1929, or the indicated Convention, as amended by the Protocol signed in Hague on September 28, 1955, depending on which of these documents can be applied to this carriage.

 

2. The rules of liability established by the Warsaw Convention are applied for the carriage hereunder this Contract with the exception of the cases where such carriage is not an “international carriage”, as defined by that Convention.

 

3. As it does not conflict with the foregoing, the carriage performed under this Contract, and other services provided by each carrier are subject to: (i) the conditions set out in the air ticket; (ii) applied tariffs; (iii) conditions of carriage and related regulations that are part of this Contract (which can be found in the Air Company’s offices).

 

4. An air ticket is valid for a flight specified therein, the date and if flight coupons are available. The insurance fee is included in the air ticket’s price. The transfer and/or resale of the air ticket to another person are not allowed. If air ticket is lost the passenger is not allowed to the carriage, the air ticket’s cost is not paid back, no duplicates are issued and no claims will be accepted.

 

5. The airline applies different types of rates and discounts, whose action is defined by the Tariff Regulations approved by the carrier. A passenger gets familiar with the Tariff Application Rules, on which the carriage is checked-in, at the sales agent when purchasing an air ticket. In the case of changing the tariff on carriage recalculations on previously purchased air tickets are not made.

 

6. The departure time indicated on the air ticket is local. Different airports have different end time for check-in. These findings are published in the timetables. A passenger should arrive in the airport by the time fixed by the carrier. In the event of failure to appear for check-in in the prescribed time, the carrier may dispose the seat at its own discretion. The passengers who are late for check-in, as well as the passengers who have passed check-in and are late for boarding, are not accepted for carriage.

 

7. The timetable may be changed without informing a passenger. Carrier undertakes to undertake its best efforts to carry the passenger and baggage within reasonable terms. Time shown in the timetables or elsewhere is not guaranteed and forms no integral part of this Contract. Carrier may hand over a passenger to another carrier without notice, replace the aircraft, alter or cancel landing in the destinations shown on the air ticket, if necessary. The carrier shall not be liable for making flight connections.

8. When checking-in and boarding the aircraft, a passenger must present an identity document and a document confirming the age of the child flying with him/her. Children under 12 years of age are transported when accompanied by adults.

9. A passenger shall comply with the requirements relating to the implementation of the passport, customs, visas, currency, sanitary and quarantine and other formalities. Passenger is responsible for the proper execution of documents, compliance with all laws, rules and regulations of public authorities of the country, from whose territory or to the territory of which such carriage is carried out. A passenger should get official information on all passport and visa matters in the embassy (consulate) of the country of destination. The airline reserves the right not to allow passengers to fly with improperly registered documents.

10. In the case if a passenger voluntarily refuses from the flight, and when the conditions of carriage (the transfer date or time of departure) are voluntarily changed then a passenger is deducted in accordance with the rules of the applied fare, on which the carriage is checked-in. Reimbursement for the unused carriage is made upon presentation of a passport or an identity document identifying the passenger and if all unused coupons are available.

11. Checked baggage will be delivered to the baggage check bearer.  The carrier’s liability for loss, damage, shortage or delay in delivering baggage accepted for carriage without the declared value shall be limited to the amount of U.S. $20 per kilo of checked-in baggage. In the case of damaging baggage during an international carriage a complaint should be made in writing to carrier forthwith after discovery of damage, but no later than seven days from the date of receipt. In the case of delay in delivery, a complaint should be made no later than

21 days from the date of the baggage carriage. Carrier assumes no liability for fragile or perishable items, money, jewelry, precious metals, securities and commercial papers, passports and other documents placed in checked-in baggage. Care for the safety of hand luggage is entirely the passenger’s one.

12. In an effort to reduce losses due to non-attendance to flights, as well as for the reasons beyond carrier’s control, the carrier may allow re-selling the seats on its flights. The carrier shall make every effort to send the passengers to their next flight, or reimburses the passenger with the amount of the bought air ticket without deduction of charges for refusal from the carriage.

13. If the circumstances that are independent from the carrier (the weather conditions at the airport of departure and/or along the air route, as well as the runway’s unavailability to serve the air vessel, information on the acts of unlawful interference to air transport activities, technical malfunction of the air vessel, etc.) require so the carrier may cancel, postpone or delay the operation of any of its flights, replace the aircraft, as well as re-route its air traffic and landing points specified in the timetable. When a flight is delayed because of the above circumstances then the carrier’s obligation is to ensure that meals and accommodation for passengers are provided for checked-in passengers only.

14. The carrier issuing an air ticket for carriage on the airlines belonged to another carrier acts, as its Agent.

15. Any exclusion or limitation of the carrier’s liability shall apply to the agents, servants and representatives of the carrier and any person whose aircraft is used for carriage by the carrier and its agents, employees or representatives of this person.
 

16. No agent, servant or representative of the carrier has authority to modify or waive any provisions of this Contract.
